Lemon laws
are a consumer protection against financial loss and
undue hardship due to the purchase of a defective
product. Most often, these laws are the last resort
for consumers who have purchased a defective vehicle
or automobile. There are many sets of laws that
address the problem of a 'lemon purchase" in the
United States.
Most motor vehicles are covered by
the Lemon Law: ATVs, Cars, Motorcycles, RVs, Trucks,
and Vans are covered. A leased or rented vehicle may
also be covered.
The Federal law is generally referred
to as the Magnuson-Moss Warranty Act. This law
protects the buyer of any product that costs more
than $25 and comes with an express written warranty.
The EPA enforces compliance with
emission/warranty claims.
The FTC (Federal Trade Commission)
enforces compliance with Federal warranty
protection.
Each of the 50 states, and some of
the territories of the United States, has adopted
the suggested Uniform Commercial Code or UCC. This
code of law covers the liabilities and
responsibilities implied in the sale of products,
and contracts in commercial transactions.

1) A buyer (other than for purposes of resale)
of any consumer product.
2) A person to whom such product
is transferred during the duration of an implied
or written warranty (or service contract)
applicable to the product.
3) A person who is entitled by
the terms of such warranty (or service contract)
or under applicable State law to enforce against
the warrantor (or service contractor) the
obligations of the warranty (or service
contract). |

A person engaged in the business of making a
consumer product directly or indirectly
available to consumers. |
warrantor |
A supplier or another person who gives or offers
to give a written warranty or who is or may be
obligated under an implied warranty. |

1) A written promise made in connection with the
sale of a consumer product, relating to the
nature of the material or workmanship and
affirming that it is defect free or will meet a
specified level of performance over a specified
period of time.
2) A written promise or
affirmation to refund, repair, replace, or
otherwise remedy such product in the event that
written specifications are not met. |

Definitions of implied warranty vary due to
State law. |

A written contract to perform specified services
relating to the maintenance or repair (or both)
of a consumer product. |
reasonable and necessary maintenance |
Maintenance services or operations which a
consumer can reasonably be expected to perform
or have performed and are necessary to keep the
product performing at a reasonable level of
performance. |
remedy |
Generally, this means repair or replacement. If
the warrantor is unable to provide replacement,
and repair is not practicable or cannot be
timely made, a refund may be made with the
agreement of the consumer. |
replacement |
A new consumer product, identical or reasonably
equivalent to the warranted consumer product,
may be substituted. |
refund |
Refunding the actual purchase price (less
reasonable depreciation based on actual use
where permitted by rules of the Commission) |
Product Liability Laws, such as Lemon
Laws,
are designed to prevent harm to a person, or to
compensate a person fo harm. Such harm includes that
from automobile accidents, decreased or loss of
income due to accidents, product failure, or harm
from workplace injuries due to defective products.
There may also be loss of income due to the
inability to get to work without transportation, or
the necessity to take time from work to meet
unreasonable maintenance or repair requirements
offered by a supplier or warrantor.

may be entitled to compensation under the law. You
should have an attorney that understands product
liability law and the lemon laws of your State.
